Stormwater runoff from construction sites can potentially impact surface water quality. As stormwater flows over a construction site, it picks up pollutants like sediment, debris, and chemicals polluting water bodies impacted. Polluted stormwater runoff can harm or kill fish and other wildlife. Sedimentation can destroy aquatic habitat by filling in small streams and creeks, and high volumes of runoff can cause stream bank erosion..

EPA's NPDES Stormwater program requires operators of construction sites one acre or larger (including smaller sites that are part of a larger common plan of development) to obtain authorization to discharge stormwater under an NPDES construction stormwater permit. The development and implementation of stormwater pollution prevention plans is the focus of NPDES stormwater permits for regulated construction activities. Most states implement their own Stormwater NPDES permitting program. In those states, a construction general Permit must be obtained prior to commencing construction activities. The Federal Clean Water Act (CWA) requires that owners and developers of land, that plan to disturb more the five (5) acres during construction, obtain a permit, prepare a Construction Best Management Practices (CBMP) Plan, and properly inspect and monitor the site until the termination of the permit. In addition to permitting and monitoring, most states require that annual and final reports be prepared that summarize the monitoring and reporting activities.
